Should the doctor be held responsible?

I hav a general surgery ONLY EXCISION 1 yr back.
The surgery is a failure.. (left side still got gyno, right got indentation & scar)

3 months back, i had another surgery wit a plastic surgery. Now, the left side gyno still left a bit at the edge of d chest (not behind d nipple) , but d right side indentation worsen. 

Before d surgery, I did tell him about d indentation but he claim its bcoz D doctor did not remove the surrounding chest area. NOW, tht area indentation /Adhesion seem worsen.

Should he be held responsible?
