Transgender sues McDonalds to get access to women's locker room

Berlin, Germany. A trangender woman sues McDonalds to get access to women's locker room. The person from Libya is living in Germany for 7 years. Five months she already has used the women's locker room, but at December 1, 2023 a female colleague had complained about her. The colleague stated that although she has breasts she has still a penis, therefore is a biological man and should have no access to the locker room for females.

The transgender woman 'Kylie' states that she needs to be protected from the views of men in the men's locker room.
McDonalds offered her to use a locker room only for herself, but she refused. For this reason McDonalds wanted to fire her, but she instantly filed for illness and sued McDonalds.

These are complex issues.

I do not think one should dismiss the view of genetic females wanting privacy no matter how progressive one is. The right of one should not be transgressed by expanding "rights" of another. One person's "rights" do not supersede another's. 

I think in this case the employer did all they realistically could.

Granted, I don't "fit" in the men's room, but fought for the right to use the all-gender restroom at the day-centre. I try to use the all-gender at the shopping mall as well, but upon occasion I find teen couples use it as a motel room and leave me no choice.

I tried the men's room at the mall once, and everyone stopped what they were doing and stared at me. If it's an emergency I'll sneak into the ladies room, but try for the all-gender. It's much nicer having the restroom to myself.

When I first transitioned at work, I agreed that it was best for the staff and myself to use my boss's private bathroom in her office. TBH, I had suggested that I would use the men's room because we didn't have any men who worked at the Breast Care Center. 

I have only been working as my true self for a few weeks, when a girlfriend of mine, in the office had told me that I should be using the ladies room with the other girls. She had already polled the everyone there and it was unanimous. HR accepted it as well. 

I was hoping for that outcome and very happy to be accepted. I didn't want to force my transition to womanhood to cause an unwanted change to the other women I work with.

I think how all of you look upon this topic, is very reasonable. Kylie was offered a locker room solely for herself but she refused to use it. This is not the way to get appreciation by most women. After the transition (surgery male to female) I'd see no obstacle anymore for using the women's restroom.

As a male RN in the 70’s & 80’s I found that at most conferences & seminars when there was a bathroom break the ladies would commander the men’s rooms in all directions, and were aggressive when challenged by my full bladder. Plenty of unreasonableness to go around now more than then, but the attitudes here on our fourum I find most reasonable. An accommodation was offered by management and rejected. Shame on the employee for spitting on the company and their desire for fairness. Striking out to marshall attention to the trans cause she had only cemented in resistance to a minority position. Not smart like Sophie, I am / was acutely aware of many cultural & social and gender/ sexual issues as an RN practicing in major university hospitals nationwide with big wig internationals as patients. I also know the other side of the coin as a male tricked and sometimes forced to take on late term abortions and having to engage with management on ADA issues concerning my hearing loss and patient safety issues. An interesting story I won’t go into detail here. I really like participating in this group as the ballast in this ship’s keel is common sense and camaraderie.

Actually, seems a bit different. The US suit shows active discrimination and disrespect.

I think the basis of both complaints is quite similar: Does a trans gender have the same rights as a genetic gender? What are the limits of those rights, if any? What if the trans person has not had bottom surgery? And other questions that are too complex to debate here. I don't have the answers. But I do know that big money is involved and many lawyers will be eager to get a piece of the action. It will be in the courts for a long time.

There’s a difference between provocation and actual disrespect and discrimination. The American suit, if you read the article, proved quite a lot of both to a JURY. A JURY that found management abused the poor girl. Too many people don’t understand that.

I have a FTM friend who hates it when people provoke. He is trying to live is life as a man and doesn't need some activist stirring up crap. It just makes his life harder. He just wants to be left alone to live his life. I get it. Me too!

I agree, parading around demanding people address you properly is no way to make friends.
Simply LIVING your life as you desire to do so is plenty.
People can accept you or not.
All the activism has made things into a political talking point further dividing people. Folks are dug in and entrenched on far sides.
Politicians quickly joining the bandwagons with new laws and ordinances on both sides.
